Terms of Service

These Terms set out the rules for using the free EchoInsight service (https://echoinsight.me), including how the contract is concluded and ended, withdrawal from the contract and complaints. Version: 2026-10-03, in force from 3 October 2026. Please read them before creating an account.

§1. Service provider and general provisions

EchoInsight is operated by Jakub Kolada, running a sole proprietorship under the business name Jakub.Solutions, NIP (Polish tax ID) 9512416493, business address: al. Solidarności 68 lok. 121, 00-240 Warszawa, Poland (“we” or the “Provider”). Contact: e-mail jakubkoladadev@gmail.com or the form on the “Contact” page of the Service.

The Service is intended for adults using it for personal purposes. This document constitutes the terms for services provided electronically under Polish law.

The Polish version of these Terms is legally binding. Versions in other languages, including this English version, are provided for information only.

Definitions:

  • Service – the EchoInsight website and chat, and what we provide through them: conversations with the AI system and account features (the Polish text distinguishes the website, “Serwis”, from the service, “Usługa”).
  • Account – your account in the Service, created when you first sign in.
  • Consumer – a natural person entering into a contract with us that is not directly related to their business or profession. We also apply the consumer provisions to a sole trader if the contract is not of a professional nature for them.

§2. What EchoInsight is

EchoInsight is a chat for spiritual reflection and for talking about what matters to you. You are talking to an artificial intelligence system, not a human. Replies are generated automatically by the Google Gemini language model based on your messages, the context of earlier conversations and our instructions. No one writes or approves the replies in real time.

EchoInsight offers reflection from a broad, non-denominational spiritual perspective. It does not represent any religion, church or religious community. Its replies are not religious teaching or statements of a religious authority.

EchoInsight is not, and does not replace:

  • therapy or help from a psychologist, psychiatrist, doctor or other specialist;
  • medical, legal, financial or any other professional advice;
  • emergency services or crisis support.

If you are in crisis or in danger

Contact emergency services or a helpline right away. EchoInsight is not a crisis service and cannot help in an emergency. When the chat recognises signs of crisis in a conversation, it shows the numbers below.

§3. Technical requirements

To use the Service you need:

  • a device with internet access;
  • a current version of Chrome, Firefox, Safari or Edge with JavaScript and browser local storage enabled;
  • an active e-mail address or a Google account (to sign in).

Security

Using the internet involves typical risks such as malware, phishing or a compromised e-mail account. We never ask for passwords or card details by e-mail. The sign-in link is single-use and valid for 15 minutes – do not share it with anyone.

§4. Account and conclusion of the contract

Only people aged 18 or over may use the Service.

You create an Account when you first sign in: with a link sent to your e-mail address or with your Google account.

Before your first conversation you tick three separate boxes (none is pre-ticked):

  • confirmation that you are at least 18 years old;
  • acceptance of the Terms and confirmation that you have read the Privacy Policy;
  • explicit consent to the processing of your conversation content, which may reveal your religious or philosophical beliefs and information about your health, in order to conduct the conversation and build a context profile (Art. 9(2)(a) GDPR).

Rules:

  • Without these three statements the chat is not available. We record the date and time of each statement and the version of the Terms accepted.
  • The contract for using the Service is concluded when you make these statements. It is free of charge and concluded for an indefinite period.
  • You may withdraw your consent to the processing of special-category data at any time. Because we cannot hold conversations without it, consent is withdrawn by deleting your Account (Profile → “Delete account”).
  • Your Account is personal. Do not share it with others and keep your e-mail inbox and Google account secure.

§5. Acceptable use and moderation

You agree to:

  • use the Service lawfully, in line with these Terms and good practice, for your own personal reflection;
  • not send content that is unlawful, obscene, sexual, abusive, hateful or harassing;
  • not try to bypass the safeguards or the model's instructions, overload the Service, scrape its content or reverse-engineer it;
  • not share other people's data (e.g. full names, addresses) in conversations beyond what is necessary.

Automated moderation:

  • Every message is checked automatically. The chat refuses to reply to an obscene or abusive message or an attempt to bypass the rules, and the message counts as a violation.
  • Five violations within 7 days automatically suspend sending messages for 24 hours. Access returns automatically after that time.
  • If you think a block was wrong, write to us (§10) – a human will review it.

Serious violations:

  • In the event of a serious or persistent breach of these Terms we may block the Account or terminate the contract with 14 days' notice, or with immediate effect where the breach is grossly unlawful or threatens the security of the Service or other people. We will tell you by e-mail and give the reason.

§6. AI-generated content

Chat replies are generated automatically and may be inaccurate, incomplete, out of date or unsuitable for your situation. We do not guarantee that they are true or fit for any particular purpose. Replies are not advice or recommendations.

You decide whether and how to use what you read. For matters of health, law, finance and safety, consult a specialist.

If a reply seems harmful or dangerous to you, report it to us (§10). Such reports help us improve our safeguards.

§7. Message limit

Every account can send 10 messages per month. Your message pool renews at the start of each calendar month in your Account's time zone. Unused messages do not carry over to the next month.

  • A message that the chat did not answer because of a technical error does not reduce your pool.
  • Once you have used your pool, you can continue in the next month.
  • Paid plans are not currently offered.

§8. Free service

The Service is currently free of charge. We do not collect any fees and do not process payment data.

If we introduce paid plans in the future, this will happen through a change to these Terms under §15, and before any purchase we will ask you to accept the purchase terms separately.

§9. Right of withdrawal

As a Consumer you may withdraw from the contract for using the Service within 14 days of the day it was concluded, without giving any reason and at no cost. To meet the deadline, it is enough to send your statement before it expires.

  • To withdraw, send us a clear statement: via the contact form in the Service (subject “Withdrawal from a contract”) or by e-mail to jakubkoladadev@gmail.com. You may use the model form in the Annex to these Terms, but you do not have to.
  • We will promptly confirm receipt of your statement by e-mail.
  • The Service is free of charge, so withdrawal involves no payments or refunds.
  • Withdrawal ends the contract: we will delete your Account and its data as described in §14 and in the Privacy Policy.
  • You can achieve the same at any time yourself by deleting your Account in your Profile (“Delete account”).

§10. Complaints and conformity of the Service

We are responsible for the conformity of the Service with the contract throughout the time it is provided, under the rules of the Polish Consumer Rights Act for digital services. If the Service does not conform to the contract, you may demand that it be brought into conformity. If that is impossible, does not happen within a reasonable time or the lack of conformity is significant, you may – on the conditions set out in that Act – withdraw from the contract.

  • You can file a complaint via the contact form (subject “I'd like to report a problem”) or by e-mail to jakubkoladadev@gmail.com.
  • Describe what the complaint concerns, when the problem occurred and what you expect. Give the e-mail address linked to your Account so we can find it.
  • We will reply by e-mail within 14 days of receiving the complaint.
  • You can raise other matters the same way, e.g. a wrongful block or a harmful chat reply.

§11. Liability

We are responsible for providing the Service properly, as described in these Terms, under the applicable law.

The Service consists of an automatically generated reflective conversation (§2 and §6). It does not include advice, diagnoses or any guarantee that replies are accurate. Decisions you make after a conversation are your own.

We make every effort to keep the Service running without interruption, but interruptions may occur, e.g. due to maintenance, failures or unavailability of providers (including the Google Gemini model). We try to carry out planned work at low-traffic times. If interruptions make the Service non-conforming, you have the rights under §10.

You are responsible for the content you send and for using the Service in breach of these Terms.

Nothing in these Terms excludes or limits our liability for personal injury, for damage caused intentionally or through gross negligence, or the rights you have as a Consumer under provisions that cannot be excluded by contract.

§12. Content and intellectual property

  • Your messages belong to you. For the duration of the contract you grant us a non-exclusive, royalty-free licence to process them only as needed to provide the Service (generating replies, conversation continuity).
  • You may use chat replies for your own personal purposes. Because they are generated automatically, we do not guarantee that they are original or protected by copyright.
  • The EchoInsight name and marks, software, design of the Service, texts and system instructions belong to us or our licensors. You may not copy or distribute them without our consent, except as permitted by law.

§13. Personal data

How we process personal data, including data revealed in conversations, is described in the Privacy Policy. In your Profile you can download your data (“Download my data”) and delete your Account (“Delete account”) at any time.

§14. Ending the contract and deleting the Account

  • You can delete your Account at any time in your Profile (“Delete account”). Deleting the Account ends the contract and cannot be undone: we delete your conversation history, context profile and account data as described in the Privacy Policy.
  • We may terminate the contract for the reasons described in §5, or with 30 days' notice if the Service is permanently discontinued. Until the notice period ends, you can download your data in your Profile (“Download my data”).

§15. Changes to these Terms

We may change these Terms only for valid reasons:

  • changes in the law, or in its interpretation resulting from court rulings or decisions of authorities, that affect these Terms;
  • the need to comply with recommendations, orders or decisions of authorities;
  • changes in how the Service works resulting from technological development, including a change of AI model or hosting provider;
  • the introduction of new features, or changes to or withdrawal of existing ones, including the introduction of paid plans;
  • the need to prevent abuse or to keep the Service and its users safe;
  • changes to the Provider's details, or editorial corrections that do not worsen your position.

How we introduce changes:

  • We will notify you by e-mail and in the Service at least 14 days before a change takes effect, showing what changes. A shorter period applies only where required by law or a decision of an authority.
  • After the change takes effect, we will ask you to accept the new version before you continue using the chat. Merely using the Service does not mean acceptance.
  • If you do not accept the changes, you can end the contract at any time free of charge by deleting your Account.
  • Introducing paid plans will not change the rules for using the free Service without your acceptance, and any purchase will require separate consent (§8).

§16. Governing law and disputes

Contracts are governed by Polish law. If you are a Consumer habitually resident in another country, you keep the protection given to you by the mandatory provisions of that country's law. Disputes are resolved by the common courts having jurisdiction under general rules.

You may use out-of-court dispute resolution, in particular free help from a municipal or district consumer ombudsman (rzecznik konsumentów), or mediation or arbitration at a regional Trade Inspection office (Inspekcja Handlowa). Information is available from the Polish Office of Competition and Consumer Protection (UOKiK): https://prawakonsumenta.uokik.gov.pl; for cross-border disputes within the EU, the European Consumer Centre can help: https://konsument.gov.pl.

If we reject your complaint, we will tell you whether we agree to out-of-court resolution of the dispute.

§17. Final provisions

These Terms are available free of charge in the Service; you can view, save and print them at any time. On request we will send you the version you accepted.

These Terms, version 2026-10-03, apply from 3 October 2026.
